Yeah, the guy was wrong, but I think the court probably should have confiscated the cell phone in the first place. A juror deliberating on corruption charges against former Sen. Vincent Fumo discussed the case on Facebook and Twitter and even promised a "big announcement" today. The defense filed an emergency motion to the court after learning of this persons posts. I smell mistrial. What a shame. We finally convict a totally corrupt politician and because this juror couldn't contain him or herself, Fumo may walk free. And so it starts... where there once was little case law to cover social media outlets in the courtroom or during a trial; new legislation will have to be constructed to avoid these [new] gray areas.
